Internet Reseller Policy

The purchaser hereby represents that it is not an “internet reseller”
of the products it is purchasing from True Pump & Equipment, Inc. The term “internet reseller” means a
business (1) whose principal activity with respect to True Pump is the purchasing of
products from True Pump without taking possession or providing installation, maintenance,
or warranty service for the items purchased and reselling those products over the internet
to a third party; and (2) that advertises or resells the products at a price less than 80%
of Aquascape manufacturer’s suggested retail price (“MSRP”). Aquascape’s current MSRP for each of its
products can be found on its web site at www.aquascapeinc.com. True Pump reserves the right to terminate sales to
internet resellers as defined above.
